Imagine a company in Abu Dhabi that has been operating successfully for several years. Its management team is focused on winning new contracts, expanding operations and maintaining profitability. The HR department is busy processing employee visas, renewing labour permits and managing payroll.

Everything appears to be under control.

Then a routine compliance review reveals a problem: the company has not fully met its Emiratisation requirements.

Management begins asking questions. How many Emirati employees must the company hire? Does the requirement apply to every business? Is hiring an employee enough, or must pension registration and payroll records also be completed? What happens if an Emirati employee resigns? And how much could non-compliance cost?

These questions are increasingly important for UAE businesses in 2026.

Emiratisation is not simply a recruitment exercise. It involves understanding the company's official target, identifying eligible skilled positions, maintaining genuine employment, coordinating payroll and pension obligations, and ensuring that employees are correctly recognised in the relevant government systems.

For business owners, the real challenge is not just meeting a target once. It is maintaining compliance throughout the year.

In this guide, we explain the UAE Emiratisation requirements for 2026, the difference between the rules for different company sizes, the financial consequences of non-compliance, the role of Nafis and pension authorities, and the practical steps employers can take to manage their obligations.

1. What Is Emiratisation in the UAE?

Emiratisation is the UAE's initiative to increase the participation of UAE nationals in the private-sector workforce by creating employment opportunities and supporting the development of national talent.

The policy encourages private companies to recruit, train and retain Emirati professionals across different industries and skilled occupations.

For employers, Emiratisation creates a responsibility to assess whether their establishment falls within the applicable requirements and, where required, achieve and maintain the official employment target.

The Ministry of Human Resources and Emiratisation (MOHRE) is a key authority responsible for administering Emiratisation requirements for establishments under its jurisdiction.

Other organisations may also be involved, depending on the employee and the particular process:

MOHRE: Employment permits, labour contracts, applicable Emiratisation targets and compliance monitoring.

Tawteen: Employment and Emiratisation-related processes and initiatives.

Nafis: Eligible employment support programmes and incentives for UAE nationals.

Abu Dhabi Pension Fund (ADPF): Pension matters for employees covered by the Abu Dhabi pension system.

General Pension and Social Security Authority (GPSSA): Pension matters for employees covered by the federal pension system.

These systems serve different purposes. Completing one process does not automatically confirm that every other obligation has been fulfilled.

2. Who Must Comply with UAE Emiratisation Rules in 2026?

One of the most common misconceptions among employers is that Emiratisation requirements apply only to large corporations.

In reality, the applicable requirements depend on factors such as the establishment's workforce size, economic activity, registration and official MOHRE records.

Two important pathways must be considered.

A. Companies with 50 or More Employees

Private-sector establishments registered with MOHRE and employing 50 or more workers are subject to Emiratisation growth targets for skilled positions, in accordance with the applicable rules.

The policy established a cumulative increase of 10% in Emiratisation rates for skilled jobs by the end of 2026, with annual growth targets and two checkpoints during 2026.

For 2026, the key milestones are:

30 June 2026: First-half target checkpoint.

31 December 2026: Year-end target checkpoint.

The Ministry has explained that covered establishments must achieve 1% growth in the Emiratisation rate of skilled jobs during the first half of 2026 and a further 1% during the second half. This results in 2% annual growth for 2026 under the applicable framework.

For employers, this means that waiting until December to review the position may be too late. Workforce planning, recruitment and compliance verification should take place well before each deadline.

It is also important to distinguish the annual growth requirement from the cumulative target. The applicable calculation and recognised workforce figures must be checked against the establishment's official records.

B. Companies with 20–49 Employees

Smaller establishments should not assume that they are automatically exempt.

Under Ministerial Resolution No. 455 of 2023, establishments with 20–49 employees operating in designated economic activities were required to employ at least one UAE national in 2024 and an additional UAE national in 2025.

For a company with 20–49 employees, the correct approach is therefore to verify its official classification and applicable obligation rather than rely solely on its trade licence or employee count.

Important: The requirements for companies with 20–49 employees are not identical to the percentage-based targets applicable to covered establishments with 50 or more employees. They should be assessed separately.
