Are you looking for civil will services in the UAE to protect your family's interests, document your inheritance wishes or plan the distribution of your assets?

Preparing a legally appropriate will is an important step for individuals who own property, maintain bank accounts, hold investments or have family members who may inherit their estate.

In the UAE, eligible individuals can register civil wills through the applicable legal and judicial frameworks. The Abu Dhabi Judicial Department (ADJD) provides a civil will registration route that may be relevant to eligible expatriates and other qualifying applicants.

Whether you are an expatriate living in Abu Dhabi, a property owner in Dubai or an international investor with assets in the UAE, understanding the registration requirements can help you make informed estate-planning decisions.

Fimkin Business Services, based in Abu Dhabi, provides assistance with civil will documentation and related registration coordination, subject to the applicable authority requirements.

This guide explains what a civil will is, who may be eligible, the registration process, required documents, potential costs and frequently asked questions.

What Is a Civil Will in the UAE?

Quick Answer: A civil will is a legal document that records an individual's wishes concerning the distribution of their estate after death, subject to the applicable UAE legal framework.

A civil will may identify:

Beneficiaries who are intended to inherit assets.
Property and financial assets covered by the will.
How eligible assets should be distributed.
An executor or other person responsible for administering the estate, where permitted.
Guardianship preferences or related family arrangements, where legally available.

The provisions that can be included depend on the applicable law and the authority registering the will.

Important: Preparing or signing a document does not automatically mean that it has been validly registered. Applicants must complete the formalities required by the relevant authority.

Why Is Civil Will Registration Important in the UAE?

Registering a civil will can provide greater clarity about how an individual's estate should be administered.

1. Clear Instructions for Asset Distribution

A properly prepared will records how the testator intends eligible assets to be distributed among beneficiaries.

2. Better Family and Inheritance Planning

Documenting inheritance wishes can help family members understand the intended arrangements.

3. Planning for Property and Financial Assets

A civil will may address eligible real estate, bank accounts, investments and other assets, subject to the applicable legal requirements.

4. Reduced Uncertainty

Clear instructions may help reduce misunderstandings between beneficiaries and simplify certain aspects of estate administration.

5. Greater Confidence in Future Planning

A civil will allows individuals to document important decisions while they are able to do so.

However, a registered will does not eliminate all probate, court or estate administration procedures.

Who Can Register a Civil Will in the UAE?

Eligibility depends on the legal framework and registration authority.

Expatriates Living in the UAE

Eligible expatriates may use an applicable will-registration route to document their estate-planning wishes.

Non-Muslim Individuals

Civil will registration routes may be particularly relevant to eligible non-Muslim individuals under the applicable civil personal status framework.

UAE Property Owners

Individuals holding eligible property interests in the UAE may wish to document how those assets should be distributed.

Business Owners and Investors

Entrepreneurs, shareholders and investors may need estate-planning arrangements addressing their business interests and other assets.

Parents with Children

Parents may wish to consider guardianship provisions where permitted under the applicable legal framework.

Eligibility note: Applicants should confirm the rules of the chosen authority, including any requirements relating to religion, nationality, residence, legal capacity and the location of assets. Civil will eligibility should not be assumed to be identical across all UAE jurisdictions.

Where Can a Civil Will Be Registered in the UAE?

Different authorities provide will-registration services under different legal frameworks.

Abu Dhabi Judicial Department (ADJD)

The Abu Dhabi Judicial Department provides civil will registration services through the relevant Abu Dhabi judicial framework.

Applicants should review the official ADJD service requirements to confirm eligibility, documentation, fees and registration procedures.

Dubai International Financial Centre (DIFC) Wills Service

The DIFC provides a separate wills registration framework for eligible applicants.

Its eligibility rules, procedures, fees and legal scope differ from the Abu Dhabi civil will system.

Other Applicable Registration Routes

Other judicial or notarial procedures may be available depending on the applicant's circumstances.

Choosing the correct route is important because the legal effect, asset coverage and registration requirements can vary.

Step-by-Step Civil Will Registration Process in Abu Dhabi

The following is a general overview of the process. Actual procedures must follow the current instructions of the relevant authority.

Step 1: Identify Your Estate-Planning Requirements

Start by reviewing your assets, intended beneficiaries and estate-planning objectives.

Consider whether the will needs to address:

Real estate
Bank accounts
Investments
Business ownership interests
Personal property
Executor appointments
Guardianship preferences, where applicable

Step 2: Confirm Eligibility for Civil Will Registration

Check whether you qualify for the selected registration route.

For Abu Dhabi civil wills, refer to the eligibility and service requirements published by ADJD.

Step 3: Prepare the Civil Will

Prepare the will using appropriate legal wording.

The document should clearly identify the testator, beneficiaries and intended distribution of eligible assets.

Where necessary, obtain advice from a qualified legal professional to ensure that the document reflects your intentions and the applicable law.

Step 4: Gather the Required Documents

Prepare your identification and relevant supporting information.

Check that names, identification details and beneficiary information are accurate.

Step 5: Submit the Registration Application

Follow the application procedure prescribed by the relevant authority.

This may involve submitting the will, supporting documents and applicable fees through an approved service channel.

Step 6: Complete Signing and Verification Formalities

The authority may require identity verification, an appointment, a declaration, a remote session or other prescribed formalities.

The will becomes officially registered only when the relevant authority has completed the required process.

Step 7: Obtain and Safeguard the Registered Will

Retain the official registration confirmation and any issued documents.

Review your estate-planning arrangements following major changes in your family, assets or circumstances.

The processing time depends on:

The selected registration authority.
Eligibility verification.
Completeness of the will.
Supporting documents.

Payment and verification procedures.

Applicants should obtain the current expected timeframe from the relevant authority or service provider.

Can Expatriates Register a Civil Will in Abu Dhabi?

Eligible expatriates may be able to register a civil will through the Abu Dhabi Judicial Department's applicable framework.

However, eligibility must be checked individually.

Factors may include the applicant's religion, nationality, legal capacity and the legal framework applicable to the proposed will.

Applicants should also confirm how the will may apply to assets outside Abu Dhabi or outside the UAE.

Can a Civil Will Cover Property in Dubai or Other Emirates?

A will may include eligible assets located in different emirates, depending on the applicable law and registration framework.

However, registration in one jurisdiction does not automatically resolve every question about the administration or transfer of assets in another jurisdiction.

Property owners should obtain appropriate legal advice about the intended scope and enforceability of their will.

Can You Include Guardianship Arrangements in a Civil Will?

Some will-registration frameworks may allow applicants to express guardianship preferences.

The availability and legal effect of these provisions depend on the applicable law and authority.

Guardianship arrangements should be reviewed carefully with a qualified legal professional, particularly where minor children or cross-border family circumstances are involved.

Can You Amend or Cancel a Registered Civil Will?

Changes may be possible through the amendment, replacement or cancellation procedures prescribed by the relevant authority.

Individuals should consider reviewing their will after significant events, such as:

Marriage or divorce
Birth of a child
Death of a beneficiary
Acquisition or sale of property
Changes in business ownership
Relocation to another country
Major changes in financial circumstances

Do not assume that an informal handwritten change automatically amends a registered will.

Common Mistakes to Avoid When Registering a Civil Will

Choosing the Wrong Registration Route

Different UAE authorities have different eligibility and registration rules.

Incorrect Beneficiary Information

Errors in names or identification details may create difficulties during estate administration.

Unclear Asset Distribution Instructions

Ambiguous wording can lead to disputes or uncertainty.

Ignoring Cross-Border Assets

International assets may be subject to additional laws and procedures.

Failing to Complete Registration

A draft will is not necessarily a registered will.

Not Reviewing the Will

A will that is not updated after major life changes may no longer reflect the testator's intentions.

Seeking qualified legal advice where appropriate can help address these issues.
